Terms of Service

These Terms of Service ("Terms") govern your access to and use of Muster ("the Service"), operated by Rocket City Enterprise LLC, doing business as Muster ("we," "us," or "our") at trymuster.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Muster is a web-based workforce scheduling platform that allows businesses ("Organizations") to manage employee schedules, time off requests, shift swaps, availability, and related workforce operations. Access is provided via a web application at app.trymuster.com.

2. Accounts and Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately of any unauthorized access to your account
• Not share your account credentials with any other person

Employee accounts may only be created via an invite link issued by an authorized manager or owner. There is no open self-registration path for employees.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service to store or transmit personally identifiable information in violation of applicable privacy laws

4. Beta Service

The Service is currently provided as a beta product. During the beta period:

• Access is provided at no charge
• Features may change, be added, or be removed without notice
• The Service is provided "as is" without any uptime guarantees or SLA commitments
• We may discontinue the beta at any time with reasonable notice

When paid plans are introduced, we will provide advance notice. Continued use of the Service after that time will be subject to the then-current pricing terms.

5. Subscription and Billing

Paid subscription plans are not yet active. When billing is introduced, additional terms governing payment, renewals, cancellations, and refunds will be provided. Payment processing will be handled by Stripe, Inc. We do not store payment card information directly.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

7. Organization Owners and Data Responsibility

If you use the Service as an organization owner or manager, you are responsible for:

• Ensuring your use of employee data complies with applicable employment and privacy laws
• Obtaining any required consent from employees before entering their personal information into the Service
• Managing access levels and permissions within your organization appropriately

8. Intellectual Property

The Service, including its design, code, and content, is owned by Rocket City Enterprise LLC and protected by applicable intellectual property laws. You retain ownership of any data you enter into the Service. You grant us a limited license to store, process, and display that data solely to provide the Service to you.

9. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases. We will retain your data for a reasonable period to allow you to export it.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or in-app notice.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in a court of competent jurisdiction.
